NoiseArt's Terms of Service

By requesting a commission from me (the Artist), you (the Client) agree to the following terms. These rules are simple, straightforward, and designed to protect both of us while keeping the process smooth and respectful.

1. Eligibility & Content

You must be 18 years or older to commission NSFW (adult) artwork. By submitting a request, you confirm you are of legal age in your jurisdiction.

I create original anime-style digital art, including NSFW themes. I accept a wide range of ideas, but I reserve the full right to decline any commission for any reason without explanation. Don't be discouraged — please feel free to ask! I love working with clients who communicate clearly and respectfully.

2. Commission Workflow

  • You submit a detailed request through my website.
  • If accepted, I begin work on the rough sketch (pre-lineart stage).
  • I share the sketch for your feedback and approval.
  • Once you approve the sketch, I send a full invoice via your chosen payment method.
  • After full payment is received, I move on to lineart, coloring, shading, and final rendering.
  • I will send regular updates throughout the process so you can follow along.

Communication is key — please respond to updates and approvals in a timely manner (ideally within 48 hours).

3. Payment Terms

Accepted payment methods:

  • PayPal
  • Chime
  • CashApp
  • Mabinogi Gold (Nexon MMO) — in-game trade arranged separately; equivalent USD value must be agreed upon in advance.
  • FF14 Gil (Final Fantasy XIV) — in-game trade arranged separately; server, character name, and equivalent USD value must be agreed upon in advance.

All prices are in USD unless otherwise stated. Payment must be made in full within 7 days of the invoice date. Partial payments are not accepted.

For Mabinogi Gold payments, I am not responsible for any issues related to your Nexon account, server problems, or in-game trade disputes.

The same applies to FF14 Gil payments — I am not responsible for issues related to your Square Enix account, server downtime, cross-server trade limitations, or any in-game trade disputes. Gil must be delivered on the agreed server and character before work on lineart begins.

4. Strict No-Refund Policy

All sales are final. No refunds, cancellations, or partial returns will be issued once payment is received — for any reason.

This policy applies even if you change your mind, request major changes after approval, or experience personal circumstances. Please only commission work you are ready to pay for and receive.

5. Cancellations & Project Termination

Before payment: You may cancel at any time with no penalty.

After payment: I will complete the piece under normal circumstances. However, I reserve the right to stop the project at any time (with or without refund) if:

  • The client becomes harassing, abusive, threatening, or disrespectful.
  • There is any breach of these terms.

In cases of client misconduct or harassment, the commission will be terminated immediately, all communication will end, and no refund will be given. I have zero tolerance for toxicity.

6. Artwork Rights & Usage

I (the Artist) retain full copyright and ownership of every piece I create.

You (the Client) receive a non-exclusive, non-transferable personal-use license only.

Allowed: Personal viewing, printing for your own private display, and sharing on social media with visible credit to me as the artist.

Strictly prohibited (without my prior written permission):

  • Commercial use, resale, redistribution, or profit-making.
  • Tracing, copying, editing for resale, NFT minting, or AI training.
  • Claiming the work as your own or removing my signature/watermark.
  • Using the artwork in any way that harms my reputation.

I may showcase the finished piece (and WIPs) in my portfolio, social media, or website for self-promotion. If you require the commission to remain completely private, please state this clearly in your initial request (a small privacy fee may apply).

Buying full copyright (optional add-on)

  • Full copyright transfer is available as a flat $75 USD add-on at the time of commissioning. It can be added to any tier and stacks on top of the base price.
  • USD only. Copyright purchases must be paid in USD (CashApp, Chime, or PayPal). Mabinogi Gold and FF14 Gil are not accepted for copyright transfers.
  • Once paid in full and delivered, the Client receives full commercial rights to the specific finished piece — including resale, reproduction, merchandising, and derivative works.
  • I retain the right to display the piece in my portfolio and social media as past work, and I retain copyright over my underlying style, brushwork, and unrelated assets. The transfer covers the finished artwork only, not my broader catalogue or process.
  • Copyright is only transferred after the copyright fee and the full commission balance have cleared. Until then, the standard personal-use license above applies.
  • Copyright transfers are final and non-refundable once the artwork is delivered.

7. Revisions & Delivery

Revisions are welcome and free during the sketch stage (before payment).

After payment, minor revisions (small color tweaks, minor pose adjustments) are possible at my discretion. Major changes or new elements may require an additional fee.

Final files will be delivered as high-resolution PNG (and PSD upon request) via email or file-sharing link.

Delivery time varies but is typically 1–4 weeks after payment, depending on complexity and current workload. I will keep you updated on any delays.

8. Client Conduct

You agree to:

  • Provide clear references, descriptions, and timely feedback.
  • Communicate respectfully and professionally.
  • Not attempt chargebacks, disputes, or payment reversals (this will result in permanent blacklisting and possible legal action).

I am not responsible for any misuse of the artwork after delivery.

9. General Legal Terms

These Terms are governed by the laws of the State of Texas, United States.

If any part of these terms is found invalid, the rest remains in full effect.

I reserve the right to update these Terms at any time; commissions are subject to the version in effect at the time of your request.

By paying the invoice, you confirm you have read, understood, and agree to every section of this document.

11. Accounts & Your Vault

Accounts are optional. You may request commissions and submit Dreams as a wanderer without ever creating one. An account (your Vault) exists purely so you can watch your own requests move, read my notes, and collect finished relics in one place.

One human, one Vault. You agree to provide an email you actually control, keep your password private, and not share, sell, or transfer your Vault. Everything done through your Vault is treated as done by you.

You may sign in with Google. If you do, I receive only your email address and basic profile name from that provider — never your password.

A Vault is a convenience, not a contract. Statuses, progress labels, and notes shown in your Vault are informal updates. They do not change, extend, or override the commission terms above, and a status shown there is never a guarantee of a delivery date.

Downloads are for you. Files delivered through your Vault carry exactly the usage rights described in Section 6 — nothing more. Availability of a download is not permanent; please save your files locally when you receive them.

I may suspend or remove a Vault. Impersonation, false claims of ownership over requests, abuse, harassment, or attempts to break the site will end your access without refund and without notice.

You may leave. Ask me and I will delete your Vault and profile details. Records I am required to keep for payment, tax, or dispute purposes, and the artwork itself, remain mine and remain archived.

12. Claiming Older Requests

Requests submitted before you made an account are not automatically attached to it. If you commissioned me or sent a Dream as a guest, you may ask for those older requests to be linked to your Vault by submitting a claim from your profile.

Claims are reviewed by hand. Every claim is checked by me personally before anything is linked. Approval is at my sole discretion and may take as long as it takes.

You must claim honestly. Only claim requests you genuinely submitted, using the email or name you originally used. Filing a claim on someone else's request is impersonation and will result in permanent removal from the site, with no refund on any active work.

Proof may be requested. I may ask you to confirm details of the original request, payment, or the email it came from. If I cannot reasonably verify a claim, I will decline it — declining a claim does not affect the underlying commission or anything already delivered to you.

Linking changes nothing about ownership. A claimed request keeps the terms, rights, and licensing it had when it was originally made, including the copyright terms in Section 6. Claiming does not grant new usage rights or re-open closed work.

Guest Dreams stay anonymous. Dreams remain non-obligating in every way described in Section 10, whether or not they end up in a Vault.

13. Your Information & Privacy

I keep what I need to do the work and nothing I do not: your name or handle, the email you gave me, your request details, any references you attached, my notes, and the finished files. Never sold, never fed to AI.

Your details, your requests, and your commissioned artwork are never sold, rented, or used to train generative models.

Private by default. Requests, references, notes, and deliverables are stored privately. Only I can see them; you can see your own through your Vault.

Some things are handled by services. Hosting, database, email delivery, and sign-in providers process this data on my behalf so the site can function. Payments are handled entirely on the platforms listed in Section 3 — I never see or store your card or banking details.

Public posting is separate. Whether a finished piece is posted publicly is governed by Section 6, not by your account settings.

Reach out any time. You may ask me what I hold about you, correct it, or have it deleted, subject to the record-keeping noted in Section 11.
